Scott D. Levine
Partner

Professional Experience

Mr. Levine concentrates his practice representing homeowner associations and individual homeowners in construction defect actions. He has been particularly successful in developing unique recovery methods for homeowners with defective windows. The Aas v. Superior Court 24 Cal. 4th 627 (2000) decision provided for smaller net recovery for homeowners in construction defect cases. However, Mr. Levine developed an alternative way to recover for his clients- going after the designers, manufacturers, and distributors of products in his client’s homes. Recently Mr. Levine successfully settled what is likely the largest window settlement in the State of California (on an amount per house basis) days before trial was set to begin.

In 2002, Mr. Levine co-negotiated California's new Construction Defect Law (SB 800, Civil Code Section 895 et. seq.). This statute was designed to obtain Aas relief for homeowners. Mr. Levine has written articles and taught seminars about the new law. In 2003, Mr. Levine worked on further revisions to SB 800 and negotiated with the BIA and others regarding other proposed changes to the law.

He has been married to his wife Amy for over twenty years. They have two children, Alexandra and Andrew. In his spare time, Mr. Levine can be found playing golf, swimming, biking, running (triathlons), or skiing with his family.
